Huffing Compressed Air, a Non-DUI

A non-DUI accident

Weston Police responded to a one-car accident on David Hill Road near Hill Farm Road on Wednesday, May 4. After arriving, at 9:25 p.m., officers found a car which had struck a tree on the shoulder of the northbound lane.

The driver, Sophie Diaz, 18, of Sunset Drive was still seated in the car, and police advised her to stay there while EMS responded. Diaz complained of pain in the ribs and a headache, and there were no visible signs of injury.

Police detected the odor of alcohol on Diaz’s breath, and she admitted to drinking prior to driving but could not remember how much she had or where she drank. Diaz was taken to the hospital.

Officers found two 50 mL bottles of alcohol in plain view in the center console, both of which were unopened.

“The accident investigation showed that Diaz was traveling southbound on Davis Hill Road attempting to negotiate a sharp downgrade curve in the road,” the police report says. “As the vehicle was coming out of the curve, it entered the northbound lane and continued to travel south. The vehicle then began to turn counter clockwise before impacting a tree on the northbound shoulder. Due to a light rain earlier in the evening, the vehicle tires left a clear print on the pavement showing the vehicle’s direction of travel.”

Police got a warrant to seize Diaz’s medical records that were taken at the hospital.

On May 15, police reported Diaz did not have an elevated blood alcohol content.

Diaz was however charged with travelling unreasonably fast for conditions, failure to drive right, failure to wear a seatbelt and possession of alcohol by a minor.

Noel Lafayette, 42, of Weston Road was charged with simple trespass after his neighbor complained to police that a car in his driveway on Sunday, May 15 at 2:27 a.m. woke up his family.

Police responded and found Lafayette sniffing Dust-Off, a compressed air product. When officers told him to stop and show his hands, Lafayette refused. Officers then removed him from the vehicle, and handcuffed him.

Once his high wore off, officers said, Lafayette said he lived next door and made a mistake. He was given a ride home, and his girlfriend was brought to bring his vehicle home.

The simple trespass infraction constitutes a $92 fine.
